NOTICE OF BUDGET COMMITTEE MEETING

A public meeting of the Budget Committee of the Owyhee Cemetery

Maintenance District, Malheur, State of Oregon, will be held to discuss the budget for the fiscal year July 1, 2019 to June 30, 2020. The meeting will take place at 1025 Owyhee Ave., Nyssa, OR 97913, on Thursday, May 16, 2019 at 6:00 p.m.

The purpose of the meeting is to receive the budget message and to receive comment from the public on the budget. A copy of the budget document may be obtained by calling 541-212-1105. This is a public meeting where deliberation of the Budget Committee will take place. Any person may appear at the meeting and discuss the proposed programs with the Budget Committee.

Reference is made to that certain Trust Deed made by 2-R’s PROPERTIES, LLC as Grantor to J. MICHAEL KULCHAK as Successor Trustee, in favor of BANK OF EASTERN OREGON, Beneficiary of the security instrument, its successors and assigns, dated September 17, 2014 and recorded on September 18, 2014 as Instrument No. Instrument No. 2014-3030, records of Malheur County, Oregon, encumbering the real property commonly known as: 435 and 475 S. Oregon Street, Ontario, Oregon 97914 and more particularly described as:

Land in ORIGINAL TOWNSITE, City of Ontario, Malheur County, Oregon, according to theOfficial Plat thereof, as follows:

In Block 16: Lots 13, 14, and 15. EXCEPTING THEREFROM the North 8 feet

of said Lot 13 and the South 15 feet of said Lot 15.

Land in ORIGINAL TOWNSITE, City of Ontario, Malheur County, Oregon, according to theOfficial Plat thereof, as follows:

In Block 16: Lots 17, 18, 19, and 20.

Both the Beneficiary and the Successor Trustee have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and notice has been recorded pursuant to Section 86.752(3) of Oregon Revised Statutes. The default for which the foreclosure is made is the Grantor’s failure to pay: (a) an installment payment in the amount of $1,494.85 due on April 20, 2018 and installments in the same amount each month thereafter, as and when due under a promissory note dated September 14, 2014; and (b) delinquent and unpaid property taxes for the years 2014 through 2018, inclusive.

By this reason of said default the Beneficiary has declared all obligations secured by said Trust Deed immediately due and payable. The balance owing as of February 25, 2019 on the obligation secured by said Trust Deed was $187,485.60 principal, plus accruing interest, costs and advances. All delinquent amounts are now due, together with accruing late charges and interest, unpaid and accruing taxes, assessments, trustee’s fees, attorney’s fees, and any amounts advanced to protect the security associated with this foreclosure.

Wherefore, notice is hereby given that the undersigned Trustee will on August 29, 2019 at the hour of 10:00 o’clock AM, in accord with the standard of time established by ORS 187.110, at the following place: on the front steps of the Malheur County Courthouse, located at 251 “B” Street West, in the City of Vale, County of Malheur, State of Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the Grantor has or had power to convey at the time of the execution by Grantor of the said Deed of Trust, together with any interest which the obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the Trustee.

Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five

(5) days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Deed of Trust reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of the principal and interest as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or Deed of Trust, and in addition to paying said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust, together with Trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778.
